The following schedule and operations of the Rockdale County Probate Court are in effect until further notice:

GUARDIANSHIP and CONSERVATORSHIP

Guardianship and conservatorship petitions for minor children and incapacitated adults must be filed by mail. Email your request to obtain the petition to complete at guardianships@rockdalecountyga.gov. Once you complete the petition, email the same address with the petition to obtain the appropriate filing fees.

Any petitioner who is required to take an oath should call 770-278-7700 for instructions.

ESTATES

All petitions will continue to be filed by mail. Prior to mailing your petition, email your completed petition to probateestates@rockdalecountyga.gov to obtain the appropriate filing fees. Any petitioner who is required to take an oath should call 770-278-7700 for instructions.

Effective as of July 15, 2021, the Georgia Supreme Court has approved the new probate court standard forms which should be used.

WEAPONS CARRY LICENSES

NO APPOINTMENTS REQUIRED – WALK INS ACCEPTED

This office cannot provide direction or guidance on the ramifications of the “Constitutional Carry” legislation which is now in effect other to note that this legislation does not affect the issuance of Weapons Carry Licenses.

New applicant – Applicant must be 21 years of age or older and a legal citizen of Rockdale County. To prove you are a resident of Rockdale County you must present a valid Georgia Driver’s License or State issued I.D. with your Rockdale County address. If your Rockdale County address is not on your Driver’s License or I.D. card, you may present alternate proof of your Rockdale County address by providing documents such as a utility bill, lease, or closing documents, if buying a home.

Please complete the weapons carry license application which can be 1. Picked up from the Probate Court or 2. Downloaded from the website.  Complete the application in its entirety; however, do not sign or date the application until you are seen by the Intake Clerk.  You will be photographed and fingerprinted by the Probate Court.

To qualify for a Georgia Weapon, Carry License, you must:

  1. Be a citizen of the United States; or,
  2. Be a Resident Alien and provide a valid Georgia Driver’s License or State issued picture I.D. card, a valid Resident Alien card, and a Georgia Hunting License (which can be obtained by logging onto georgiawildlife.com); or,
  3. Be a Permanent Resident and provide a valid Georgia Driver’s License or Georgia State issued picture I.D. card, a Permanent Resident Card; or,
  4. Employment authorization with a valid Georgia Driver’s License or Georgia State issued picture I.D. and a Georgia Hunting License (which can be obtained by logging onto georgiawildlife.com or,
  5. If you were born outside of the U.S.A., you must provide proof of lawful presence in the United States at the time of application (U.S. Passport, Resident Alien Card, Permanent Resident Card, Immigrant Visa, Student Visa, Citizenship Certificate, Naturalization Certificate; or
  6. If you were born abroad in the U.S. Military, you must provide a copy of your birth certificate at the time of application.
MARRIAGE LICENSES

Georgia residents who wish to get married in Georgia may obtain a marriage license in any Georgia County. Non-residents must obtain a marriage license in the County in which the marriage ceremony will occur. Both parties must be present to obtain a marriage license. Please bring State issued identifications or a passport to obtain to the marriage license. In the event of being previously married, please bring your most recent divorce decree or a death certificate if a widow.

VITAL RECORDS: BIRTH AND DEATH RECORDS

To request a certified copy of a birth or death certificate, please come to the Court to request the vital record. State-issued identification is required to obtain the vital record.

Funeral homes and crematories must email your request to probatevitalrecords@rockdalecountyga.gov. There is a 2-hour window for your request to be completed. The Court will notify you when your request is completed.

Order to Apprehend

The Form for Lay Affidavit for Mental Health Pick-Up Order (Form) is used to initiate the process of involuntarily transporting an individual to an emergency receiving facility for a mental health evaluation. The intended use of the Form is for individuals who:

  1. Are in imminent danger to self/others, evidenced by recent overt acts or expressed threats of violence or self-harm, or who are,
  2. Unable to care for their own physical health and safety so as to create an imminently life-endangering crisis and in need of involuntary treatment.

Once the Form is completed and filed with the Probate Court, the Judge may issue an order commanding any law enforcement officer to take such person into custody and deliver him/her to the nearest emergency receiving facility for examination.  This order is commonly referred to as an “Order to Apprehend,” because it directs law enforcement to apprehend a person and take them an emergency receiving facility for a mental health evaluation.

Form REQUIREMENTS
  1. Affidavits of at least 2 witnesses.
  2. Both Affiants must have witnessed the persons behavior in the preceding 48 hours.
  3. Based upon the observations contained in the Affidavits, the Affiants have reason to believe such person requires involuntary treatment because that person is:
    i.     a mentally ill person,
    ii.    an alcoholic,
    iii.   a drug dependent individual, or
    iv.   a drug abuser.
  4. The person must be a resident of Rockdale County or located in Rockdale County.
  5. The person must be at least 17 years of age or older.  (Jurisdiction for those 16 and younger is in Juvenile Court.)

Monday – Friday from 8:30 AM – 4:00 PM (excluding weekends and holidays).  Please call 9-1-1 during non-business hours or in case of an emergency.

Fees

There is no fee for an Order to Apprehend.

Our office accepts cash, cashier’s check, money orders, MasterCard and Visa credit/debit.  There is a $4.00 processing fee for all card payments.
